1. Agreement
By creating an account or using TheStuHub Mail Tracker (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you don't agree, don't use the Service. If you're using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. The Service
TheStuHub Mail Tracker is a Gmail-integrated tool that records per-message metadata when you choose to track an email — open events, link clicks, recipient device and approximate location — and presents that data on a real-time dashboard. It consists of a Chrome extension, a web dashboard, and a backend API.
3. Eligibility
You must be at least 16 years old to use the Service. You must comply with all laws applicable to you. You may only use the Service in connection with a Gmail account you own or are authorized to use.
4. Account registration
- You must provide accurate, current information during registration.
- You are responsible for keeping your password confidential and for all activity under your account.
- One account per person, except where you join an organization on a team plan.
- Notify us immediately at hello@thestuhub.com if you suspect unauthorized use.
5. Acceptable use
You agree not to:
- Use the Service in violation of any law applicable to you, including email-tracking laws in your or your recipient's jurisdiction (see §6).
- Send spam, harassment, hateful content, malware, or phishing emails.
- Attempt to circumvent rate limits, scrape the Service, or reverse-engineer the API or extension.
- Resell tracking-as-a-service or build a derivative product on top of the Service without an explicit enterprise agreement with us.
- Use the Service to track emails to recipients you reasonably believe would object, including in scenarios where transparent disclosure of tracking is required by law.
6. Recipient consent and law compliance
Email-tracking is regulated differently across jurisdictions. You — not TheStuHub — are responsible for ensuring your use of the Service complies with the laws applicable to you and your recipients. This may include (without limitation) the CAN-SPAM Act (US), ePrivacy / GDPR (EEA), CASL (Canada), PECR (UK), the Telecom Consumer Protection Regulations (Pakistan), and similar regimes elsewhere.
7. Subscription plans and payment
- Plans and pricing are listed on the marketing site. Free plan limits (10 tracked emails / month, 7-day event history) and paid plan features may change with notice.
- Paid subscriptions are billed monthly or annually in advance via Stripe. Annual plans receive a discount as listed on the pricing page.
- Subscriptions automatically renew at the end of each billing period unless cancelled before renewal.
- Prices are in USD unless otherwise stated.
8. Refunds and cancellation
- You may cancel any time from the dashboard. You retain access to paid features until the end of the current billing period; the subscription does not renew thereafter.
- First-time paid subscriptions are eligible for a full refund within 14 days of the initial payment, on request to hello@thestuhub.com.
- We do not refund partial periods after the 14-day window or for subsequent renewals.
9. Free plan
The Free plan permits up to 10 tracked emails per calendar month and retains tracking events for 7 days. Free-plan limits may change with reasonable notice; we'll tell you in-product or by email before material changes.
10. Trial period
We do not currently offer free trials of paid plans. The Free plan serves as the trial.
11. Intellectual property
The Service, including all software, designs, branding, and content we create, is owned by TheStuHub and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service while your account is active and in good standing.
You retain all rights to the content you create — including the emails you compose. We claim no ownership over your messages or recipient lists.
12. User content
You are solely responsible for the emails you send through the Service and for ensuring you have the right to send them. We do not store the body of your emails (see the Privacy Policy), so you retain full custody of their content.
13. Service availability
We aim to keep the Service available continuously. We do not guarantee uptime on the Free plan. Paid plans include best-effort availability; Business and Enterprise plans include a target of 99.5% monthly uptime as measured at the public API endpoint, with credits available for sustained outages on request. Scheduled maintenance is announced in advance where possible.
14. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied. The accuracy of email tracking depends on the recipient's mail client behavior — many mail providers proxy, cache, or block tracking pixels, and some recipients may have images disabled entirely. We don't warrant that tracking will be instantaneous, comprehensive, or accurate in all cases.
15. Limitation of liability
To the maximum extent permitted by law:
- TheStuHub's total aggregate liability for any claim arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 100.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages — including lost revenue, lost deals, lost data, or business interruption — even if we've been advised of the possibility.
16. Indemnification
You agree to indemnify and hold harmless TheStuHub, its officers, employees, and agents from any claim, damage, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms, applicable law, or third-party rights.
17. Termination
We may suspend or terminate your account if you materially breach these Terms or use the Service in a way that puts our infrastructure or other users at risk. We'll give you reasonable notice unless the breach is immediate and severe. You may delete your account at any time from the dashboard or by emailing hello@thestuhub.com.
18. Modifications to the Service or these Terms
We may update the Service and these Terms from time to time. For material changes to these Terms, we'll notify you by email or via an in-product banner at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
19. Governing law and dispute resolution
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-laws principles. The courts of Sahiwal, Pakistan have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
20. Severability and entire agreement
If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and TheStuHub regarding the Service and supersede any prior agreements.
